Conditions of Sale

Orders: Are confirmed subject to crop conditions or errors in count, and with the understanding the same shall be void should injury befall stock from causes beyond our control.

 

Prices: Are subject to change without notice.  All prices are F.O.B. point of origin.

 

Terms: Are net 30 days to those who have established credit with us.  To new customers cash, security or satisfactory reference is required prior to shipment.  Overdue accounts are subject to a service charge of 1 1/2% a month or 18% annually.

 

Warranty: Miles Nursery, Inc. takes pride in the quality of plant material sold, and takes great care to have all plants true to name.  Nevertheless, we give no warranty, expressed or implied as to productivity of any nursery stock we sell.

 

Claims: Must be made within five days of receipt of shipment and all stock must be held for our disposition.  We shall in no case be held liable for any sum greater than the amount originally received in stock.  Our responsibility ceases when the stock is delivered to carrier.
